CollectIT's Terms and Conditions

These terms and conditions are, wherever possible, in accordance with the law, but where a term of use contravenes statute, then the law will prevail.

You acknowledge that in the event that a debt is recovered, CollectIT will receive it’s commission as outlined when loading the debt and on the authority to act.

You have engaged the services of CollectIT and agree to pay their commission as outlined when loading the debt and on the authority to act, should your debtor refuse to pay these whether or not the debtor is legally liable.

You undertake to inform CollectIT immediately if you receive any communication and/or payment from the debtor. You will pay CollectIT’s commission within 7 days of receiving payment should the debtor pay you directly. You acknowledge that CollectIT reserves the right to charge interest of 15% per annum on any outstanding commission owing by you to CollectIT.

Failure to make payment on any invoices when due will result in interest (15% per annum), collection costs and solicitors fees being on-charged.

If you accept a lesser sum in settlement of the debt then the commission as outlined when loading the debt and on the authority to act is payable on that lesser sum.

Should you accept settlement of the full amount of the debt by means other than money ie. swapping of services, Bartercard etc,  commission will be payable to CollectIT on the full amount of the debt.

Should you accept settlement of any portion of the debt by means other than money, ie. swapping of services, Bartercard etc the commission is payable on that portion of the debt.

You understand that CollectIT reserves the right to reject at any time during the process, debts presented for collection that do not meet with its criteria and/or contain incorrect, false or misleading information.

In the event that a debtor commences repayment and you wish to uplift your file and take over the repayments by the debtor, your file is unable to be uplifted until either the debt is repaid in full by the debtor and CollectIT has taken its’ commission plus GST. Alternatively you pay to CollectIT the full commission on the entire debt plus GST as if the debt had been repaid in full.

CollectIT reconciles all payments from debtors after the end of each month. Creditor payments are then processed following reconciliation. Creditor payments outside these dates will incur a $20 administration fee which will be deducted from payment.

Amendments
CollectIT reserves the right to amend these terms and conditions from time to time. Such amendments are effective immediate upon inclusion in this website.
You agree to ensure that registration details are true and accurate.

Governing Law
These terms and conditions are governed by the Laws of New Zealand. You agree to submit to the exclusive jurisdiction of the Courts of New Zealand and in particular, if any action is to be taken between you and CollectIT , then the Court which is to be used is Hamilton, New Zealand.

The content of this website is the property of CollectIT. The information contained in this website is provided to the subscriber of the website under licence agreement. It is against the Copyright Act 1996 to copy the information onto any medium except as specifically allowed in the licence agreement.
